2. Current Status of the Shop
The online shop at bamix.com is currently inactive and serves primarily as an information platform.
A reactivation of the shop is planned. These T&C apply as soon as ordering functionality is available again.
3. Territorial Scope & Partner Network
3.1 Delivery Area
We only deliver to selected countries within the European Union that do not have an official local bamix® distributor.
3.2 Excluded Territories
To protect our authorized service and distribution network, we do not ship to countries with official local partners.
In these cases, customers are required to order via their local distributor or service partner.

4. Conclusion of Contract
The presentation of products constitutes an invitation to place an order, not a binding offer.
By clicking “Buy Now”, you submit a binding offer.
The contract is concluded upon:

Partial deliveries are permitted if reasonable.
5. Prices, VAT & IOSS Import Handling
All prices are shown in EUR and include statutory EU VAT.
IOSS (Import One Stop Shop)
Orders are shipped from Switzerland using the IOSS procedure.
EU VAT is collected at checkout and prepaid.
Normally, no additional import taxes or customs charges should occur.
However:
Local carriers or authorities may exceptionally charge handling fees. These are beyond our control and remain the responsibility of the customer.
6. Shipping Costs & Delivery Times

Orders below €150.00: €30.00 flat rate
Delivery time: typically 5–7 business days
If delivery fails due to incorrect address or absence, any additional costs are borne by the customer.
7. Right of Withdrawal (EU Consumer Law)
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day you (or a third party named by you) received the goods.

We will refund all payments received from you, including standard shipping costs, within 14 days after receiving your withdrawal notice.
We may withhold the refund until:

9. Return of Goods

You are liable for any diminished value resulting from handling beyond what is necessary to check the goods.
When returning goods from the EU to Switzerland, the customer must ensure correct customs declaration (marked as 'Return Goods') to avoid unnecessary duties. Any costs arising from incorrect declaration will be deducted from the refund.
10. Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to:

11. Returns & Repairs – Important Limitation
Returns, warranty claims and repairs are only handled for products purchased directly via this shop (bamix.com).
Products purchased from local distributors or partners must be handled by the respective local service centers.

12. Warranty & Motor Guarantee

Lifetime motor warranty applies according to bamix® conditions (for eligible devices)
Warranty excludes:

Normal wear and tear

Improper use

Unauthorized repairs or modifications
13. Liability
We are liable for:

Intent and gross negligence

Breach of essential contractual obligations (limited to foreseeable damage)
Liability for personal injury and product liability remains unaffected.
14. Retention of Title
The goods remain the property of ESGE AG until full payment has been received.
15. Applicable Law & Jurisdiction
Swiss law applies, excluding the CISG.
This does not limit your mandatory consumer protection rights in your country of residence.
Jurisdiction: Mettlen, Switzerland, unless mandatory consumer law provides otherwise.
16. Online Dispute Resolution (EU)
The European Commission provides a platform for online dispute resolution:
